Who Can Use Nutrition Compass

Nutrition Compass is a clinical nutrition workspace built for licensed and credentialed nutrition and dietetic professionals. It is not intended for use by patients or the general public, and we may ask you to provide credential information, such as a national credential, state license, or National Provider Identifier, to verify your eligibility before or during your trial or subscription.

You must be at least 18 years old and capable of forming a binding contract to use the Service.

Free Trial

We may offer a free trial of Nutrition Compass for a limited period (currently 14 days) without requiring a credit card. At the end of the trial period, continued access to Nutrition Compass requires an active paid Subscription. We may modify, limit, or discontinue the free trial offer at any time, at our sole discretion.

Subscriptions & Billing

Access to Nutrition Compass beyond any trial period is billed on a recurring, monthly subscription basis (a “Subscription”). Subscription payments are processed by Stripe. By providing payment information, you authorize us, through Stripe, to charge your payment method for all applicable Subscription fees.

Your Subscription renews automatically at the end of each monthly billing cycle unless you cancel before the renewal date. You may cancel at any time by contacting us at info@persephone-nutrition.com; cancellation takes effect at the end of your current billing cycle, and we do not prorate partial months.

If a payment cannot be processed, we may suspend your access to Nutrition Compass until a valid payment method is provided and any outstanding balance is paid.

Fee Changes

We may change Subscription fees from time to time. We will provide reasonable advance notice of any fee change before it takes effect for your account. Continuing to use the Service after a fee change takes effect means you accept the new fee.

Refunds

Subscription fees are generally non-refundable. We may consider refund requests on a case-by-case basis at our sole discretion; to request one, contact info@persephone-nutrition.com.

Accounts

You must provide accurate, current information when creating your account and keep it up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at info@persephone-nutrition.com if you suspect unauthorized use of your account.

Your Content & Client Data

In the course of using Nutrition Compass, you may enter patient or client information, assessments, notes, and other data (“Content”). As between you and us, you retain ownership of your Content. You represent that you have the right to enter this Content into the Service, including any consent required from your patients or clients, and that doing so does not violate any law or third party’s rights.

You grant us a limited license to host, store, process, and display your Content solely as necessary to operate and provide the Service to you. If you are a healthcare provider subject to HIPAA or a similar privacy law and intend to store protected health information in Nutrition Compass, contact us at info@persephone-nutrition.com to discuss an appropriate data protection or business associate agreement before doing so.

You are solely responsible for your Content and for maintaining your own backup copies of anything you consider critical. On request, we will provide reasonable assistance exporting your Content, subject to the data retention practices described in our Security & Privacy page.

Clinical Use & Professional Judgment

Nutrition Compass provides calculations, references, and documentation tools to support the nutrition care process. It is a tool for use by trained nutrition and dietetic professionals, not a substitute for clinical judgment, medical diagnosis, or the standard of care applicable to your practice. You remain solely responsible for the assessments, diagnoses, care plans, and clinical decisions you make in connection with your use of the Service, and for independently verifying any calculation, reference value, or output before relying on it in patient care.

Acceptable Use

You agree not to: use the Service for any unlawful purpose; attempt to gain unauthorized access to the Service, other accounts, or our systems; interfere with or disrupt the integrity or performance of the Service; reverse engineer, decompile, or attempt to extract the source code of the Service, except where applicable law permits; or use the Service to store or transmit content that is unlawful, infringing, or that you do not have the right to submit.

Intellectual Property

The Service, including its software, design, text, graphics, clinical reference content, and the Nutrition Compass and Persephone Nutrition names and logos, is owned by Persephone Nutrition Sciences LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable license to access and use the Service for your own professional practice. This license does not include any right to resell, sublicense, or create derivative works from the Service.

Third-Party Services

The Service relies on and may link to third-party services, including Stripe for payment processing, Microsoft Azure for hosting, and public reference data sources such as USDA FoodData Central and published growth references. These third parties operate under their own terms and privacy practices, which we do not control. If you use our Patient Portal integration, that portal is hosted by Practice Better under Practice Better’s own terms, available at practicebetter.io/terms.

Termination

You may stop using the Service and cancel your Subscription at any time as described above. We may suspend or terminate your access to the Service if you breach these Terms, if required by law, or if your Subscription payment is not resolved after reasonable notice. Upon termination, your right to use the Service ends, and we will handle any remaining Content in accordance with our data retention practices.

Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure, or that any calculation, reference, or output will be accurate or complete for every clinical situation.

Limitation of Liability

To the fullest extent permitted by law, Persephone Nutrition Sciences LLC and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of, or inability to use, the Service, even if we have been advised of the possibility of such damages. Our total liability arising out of or related to these Terms or the Service will not exceed the amount you paid us for the Service in the twelve months preceding the claim.

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

Indemnification

You agree to indemnify and hold harmless Persephone Nutrition Sciences LLC and its officers, employees, and agents from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Service, your Content, or your breach of these Terms.

Governing Law

These Terms are governed by the laws of the State of Oregon, without regard to its conflict of laws principles. If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect.

Changes to These Terms

We may update these Terms from time to time. If we make a material change, we will provide reasonable notice, such as by posting an updated “Last updated” date on this page or by emailing the address associated with your account. Continued use of the Service after a change takes effect constitutes acceptance of the revised Terms.
